Compliance with FIA Requirements for CSOs in Uganda

Background of the Training

Non-profit Organisations (NPOs) perform a vital role in society, providing relief and support to populations in need, and at times during urgent crisis. Unfortunately, they have also been used to provide cover for the financing of terrorism. As a countermeasure, after the 9/11 bombings, the Financial Action Task (FATF) was formed.

FATF is an inter-governmental body established in Paris in 1989 by the Group of 7 (G7). The objectives of the FATF are to set standards and promote effective implementation of legal, regulatory and operational measures for combating money laundering, terrorist financing and other related threats to the integrity of the international financial system.

It is a “policy-making body” which works to generate the necessary political will to bring about national legislative and regulatory reforms in these areas. As a member of FATF, Uganda has subsequently enacted anti-money laundering and counter-terrorism financing laws including the Anti-Money Laundering Act which established the Financial Intelligence Authority whose primary mandate is to monitor, investigate and prevent money laundering in Uganda.

As a follow up from the February 2018 dialogue between NPOs, banks and the FIA, it was evident and highly recommended that FIA creates awareness on compliance, standards and best practices for NPOs in Uganda:

Training Objectives

  1. To create awareness on the existing legal framework within which Anti-Money Laundering and Anti-Terrorism Financing laws are enforced in Uganda.
  2. To create awareness on the pertinent standards and best practices for regulation and monitoring of NPOs.
  3. To enhance coordination and collaboration between the FIA and NPOs during national risk assessment and mutual evaluation process.

Training Content

The training shall be delivered by two experts from the FIA and faculty from DPI through presentations and round-table discussions. The following broad themes are expected to be covered during the training:

  1. Overview of Relevant International Standards and Implication for Non-Profit Organisations (NPOs),
  2. FATF Special Recommendation VIII: Implementation Status of Uganda as member states,
  3. Preventing and Protecting the NPO Sector from Terrorism Financing Abuse: Uganda Experience,
  4. Typologies of Terrorist Abuse of The NPO Sector,
  5. Engagement with the NPO Sector during National Risk Assessment Process: National Experience,
  6. Consultation & Involvement of NPOs in the Mutual Evaluation process (Pre-onsite, Onsite and Post-Onsite).
